This document, together with the other documents referred to in it, governs the conditions applicable to the use of this Website and to the purchase of products and services through it (the “Conditions”).

For the purposes of these Conditions, the activity carried out through the Website comprises the sale and distribution of all types of batteries and accumulators, as well as products related to automotive spare parts.

In addition to these Conditions, before accessing, browsing or using this Website the User should have read the Legal Notice and General Conditions of Use, which include the information on data protection and cookies. By using this Website, or by requesting the purchase of a product or service through it, the User agrees to be bound by these Conditions; if the User does not agree with them, they should not use this Website.

These Conditions may be amended. The User is responsible for consulting them each time they access the Website, since the Conditions in force at the time the purchase is requested will apply.

For any question regarding the Conditions, the User may contact the owner using the contact details above or the contact form.

2. The User

Accessing, browsing and using the Website confers the status of user (the “User”). From the moment browsing begins, all the Conditions set out here are accepted, together with any subsequent amendments, without prejudice to the application of mandatory law applicable in each case.

The User assumes responsibility for the correct use of the Website, which includes:

• not making any false or fraudulent purchase. Where it may reasonably be considered that such a purchase has been made, it may be cancelled and the relevant authorities informed;

• providing truthful and lawful contact details, in particular an email address, a postal address and any other data required.

The User declares that they are over 18 years of age and have the legal capacity to enter into contracts through this Website.

This Website is aimed at consumers in the European Union. The shipping destinations available, together with their delivery times and costs, are shown during the purchase process; telebaterias.com does not guarantee shipping to, or compliance with the legislation of, countries other than those offered as an available destination at that time.

The User may enter into the contract of sale in any of the languages in which these Conditions are available on this Website.

3. Purchase process

Users may purchase on the Website by the means and in the manner provided, following the online purchase procedure: several products may be selected and added to the basket and the purchase then confirmed.

The User must complete and check the information requested at each step and may modify the details of the purchase before making payment.

The User will then receive an email confirming that telebaterias.com has received the order, that is, the order confirmation. The User will likewise be informed by email when the order is dispatched. This information is also available in the User's personal area of the Website.

Once the purchase procedure has been completed, the User agrees that the Website will issue an electronic invoice, which will be sent to the User by email and, where applicable, made available in their personal area. The User may request a paper copy of the invoice using the contact details provided.

The User acknowledges being aware, at the time of purchase, of the particular conditions of sale relating to the product concerned, which are shown next to its description or image on its page of the Website, including by way of example its name, price, components, weight, quantity, colour, details and characteristics; and acknowledges that placing the order constitutes full acceptance of those particular conditions.

Unless expressly stated otherwise, telebaterias.com is not the manufacturer of the products sold on the Website. Although every effort is made to ensure that the information displayed is correct, the packaging, materials or components of the products may contain additional or different information from that shown on the Website. The User should therefore consider not only the information on the Website but also that available on the labelling, warnings and instructions accompanying the product.

4. Availability

All orders received through the Website are subject to the availability of the products and to no circumstance of force majeure (clause 9 of these Conditions) affecting their supply.

Should difficulties arise in supply, or should stock be unavailable, telebaterias.com undertakes to contact the User and refund any amount paid. In no case will an amount greater than that paid by the customer be refunded.

5. Prices and payment

Prices shown on the Website are final prices, in euros (€), and include applicable taxes, unless a legal requirement, in particular regarding VAT, indicates and applies otherwise.

Unless otherwise stated, the prices of the items offered exclude shipping costs, which will be added to the total due when the User manages the shipping procedure, where they will be able to consult the available methods and costs and freely choose the one that suits them best.

In no case will the Website automatically add costs to the price of a product; only those that the User has freely and voluntarily selected.

Prices may change at any time but, save for pricing errors, any change will not affect orders for which the User has already received an order confirmation and for which stock was available at the time the order was placed.

Payment methods. The payment methods available are shown during the purchase process and may vary depending on the destination of the order, its value and the agreements in force with payment providers. The particular conditions of each payment method are set out below where they apply.

telebaterias.com uses all means at its disposal to guarantee the confidentiality and security of the payment data transmitted by the User, in particular the encryption of communications using the HTTPS protocol. telebaterias.com does not store complete payment card data.

Where the User selects card payment, the transaction is processed on the bank’s payment gateway, outside this shop. Cards are subject to the checks and authorisations of the issuing bank; if the bank does not authorise the payment, the order is not completed and telebaterias.com will not be responsible for any delay or failure to deliver.

Where the payment method is PayPal, the charge is made when telebaterias.com sends the order confirmation.

In every case, by making the purchase the User confirms that the payment method used is their own.

Orders for which the User selects bank transfer are reserved for 5 calendar days from the order confirmation, so as to allow sufficient time for the transfer to be registered by the payment system. Once the full amount of the order is received in the account, less any bank charges for receiving the transfer, the order will be prepared and dispatched.

With this payment method, the User must make sure to enter the exact amount of the order, the account number and the transfer reference correctly. If those details are wrong, or if the correct amount is not received, telebaterias.com will not be able to validate the order, which will be cancelled and the amount received refunded, less any charges for issuing the transfer.

For cash on delivery, the User must select that option among the payment methods and complete the order. From that moment, telebaterias.com reserves the right to contact the User in order to validate the order. Payment is made on delivery, to the carrier's driver, and in cash only. The User undertakes to hand over the exact amount of the order, as the driver cannot give change.

For refunds of orders paid by cash on delivery, telebaterias.com has 14 calendar days from the date the return was requested and the parcel returned. The User must provide their bank details, since refunds for these orders are made exclusively by transfer.

telebaterias.com reserves the right to suspend cash on delivery for Users who have not met the necessary requirements in previous orders.

6. Delivery

Except in cases of unforeseen or extraordinary circumstances, such as stock shortages, the order will be delivered within the period indicated on the Website for the shipping method selected and, in any event, within a maximum of 30 calendar days from the date of the order confirmation, unless a different delivery date is notified and accepted by the User.

Orders are dispatched on working days and not on public holidays in the locality of dispatch, which may cause delays in relation to the delivery period indicated.

If, for a reason attributable to telebaterias.com and not to the carrier, the delivery date cannot be met, the User will be contacted and may choose either to proceed with the purchase, setting a new delivery date, or to cancel the order with a full refund of the price paid.

If delivery cannot be made because the User is absent, the order may be returned to the warehouse. The carrier will leave a notice explaining where the order is and how to arrange redelivery.

If the User will not be at the delivery address during the agreed time slot, they should contact telebaterias.com or the carrier directly to arrange delivery on another day.

Where 30 days pass from the date the order is available for delivery without delivery taking place for reasons not attributable to telebaterias.com, it will be understood that the User wishes to withdraw from the contract, which will be deemed terminated. As a result, all payments received from the User will be refunded, except for additional costs resulting from the User's own choice of a delivery method other than the least expensive ordinary delivery offered, without undue delay and in any event within a maximum of 14 calendar days from the date the contract is deemed terminated. The User should bear in mind that the transport arising from the termination may carry an additional cost that may be passed on to them.

For the purposes of these Conditions, delivery is deemed to have taken place when the User, or a third party indicated by the User, acquires physical possession of the products, evidenced by signing for receipt at the agreed delivery address.

The risk of loss or damage to the products passes to the User from the moment of delivery. The User acquires ownership of the products when telebaterias.com receives full payment of all amounts due, including shipping costs, or on delivery if this takes place later.

The applicable VAT rate will be the one legally in force at any given time, depending on the item concerned and its destination.

Where the product purchased is unavailable, telebaterias.com may propose replacing it with another product of the same dimensions and characteristics and of higher performance; any such replacement is subject to the User's acceptance.

7. Technical means of correcting errors

Should the User detect an error in the data entered to process their order, they may correct it by contacting telebaterias.com through the contact channels available on the Website or using the details given in clause 1. These details may also be corrected by the User in their personal area of the Website.

In any event, before confirming the purchase the User has access to the basket, where the selected products are listed, and may make changes.

8. Returns

Right of withdrawal

The User, acting as a consumer, has the right to withdraw from the purchase within 14 calendar days without giving any reason, in accordance with Directive 2011/83/EU on consumer rights as transposed in the User's country of residence. As a matter of commercial policy, telebaterias.com grants a period of 15 days.

This period expires 14 calendar days after the day on which the User, or a third party authorised by them other than the carrier, acquired physical possession of the goods; where the goods making up the order are delivered separately, 14 days after possession of the last of those goods was acquired; and, in the case of a contract for services, 14 days after the date the contract was concluded.

To exercise this right, the User must notify their decision to telebaterias.com, which they may do through the contact channels available on the Website or by email to info@telebaterias.com. The statement must be clear and unequivocal. The User may use the withdrawal form made available by telebaterias.com, but its use is not compulsory.

To meet the deadline, it is sufficient for the communication to be sent before the period expires.

In the event of withdrawal, telebaterias.com will refund all payments received for the product without undue delay and in any event within a maximum of 14 calendar days from the date it is informed of the decision. The refund will be made using the same payment method used for the initial transaction and will not entail any additional cost for the User. telebaterias.com may withhold the refund until it has received the products and verified their condition.

The User must return the products without undue delay and in any event within a maximum of 14 calendar days from the date the decision was communicated, to the following address:

The return address is the one given in clause 1 (General information), unless a different address is provided when the return is processed.

Cost of return. Having been informed beforehand through the Shipping and returns page, the User bears the direct cost of returning the goods in the following cases: shipments to destinations outside mainland Iberia (including Portugal, Madeira, the Azores, the Balearics and other countries) and orders dispatched by industrial transport. In all other cases, telebaterias.com collects the product at no cost to the User.

The User is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

No refund will be made where the product has been used beyond mere inspection, where it is not in the same condition in which it was delivered or where it has been damaged after delivery. Products must be returned with all their original packaging, the instructions and any other accompanying documents, together with a copy of the purchase invoice.

There are exceptions to the right of withdrawal, set out in Article 16 of Directive 2011/83/EU as transposed in the User's country of residence, in particular: goods made to the consumer's specifications or clearly personalised; goods liable to deteriorate or expire rapidly; sealed goods which are not suitable for return for health protection or hygiene reasons and were unsealed after delivery; and sealed audio or video recordings which were unsealed after delivery. The right of withdrawal likewise does not apply where a service has been fully performed with the consumer's prior express consent and acknowledgement that the right would be lost.

Return of defective products or errors in the shipment

Where the User considers that, at the time of delivery, the product does not match what was contracted, they must contact telebaterias.com immediately and report the lack of conformity (defect or error) by the means indicated in the previous section.

The User will then be told how to return the products. Returned products will be examined and the User will be informed, within a reasonable period, whether a refund or a replacement will be provided. Where it is determined that there is no lack of conformity, neither a refund nor a replacement will be provided and the User must bear the costs arising from the inspection and the return of the product.

The refund or replacement will be carried out as soon as possible and in any event within 14 days of the date on which we send the email confirming that a refund or replacement is due. The amount paid for products returned because of a defect that genuinely exists will be refunded in full, using the same payment method used for the purchase.

Legal guarantee of conformity

A User acting as a consumer benefits from the legal guarantee of conformity granted by the applicable legislation, and telebaterias.com may neither reduce nor limit that right. Within the period laid down by law at any given time, the consumer may require the repair or replacement of non-conforming goods and, under the conditions provided for by law, a price reduction or termination of the contract, at no cost to them.

This legal guarantee is independent of, and applies in addition to, any commercial warranty offered by the manufacturer. The specific period and conditions are those laid down by the legislation in force at the time of purchase and, where the consumer resides in another Member State, those granted by the law of their country of habitual residence where that law is more favourable to them.

Products are deemed to be in conformity with the contract provided that they:

• match the description given by telebaterias.com and possess the qualities presented in it;
\\n
• are fit for the purposes for which goods of the same type are ordinarily used, including the service life to be expected given their use;
\\n
• show the quality and performance usual in a product of the same type and reasonably to be expected of it.

Where that is not the case, the User should proceed as indicated in the section “Return of defective products or errors in the shipment”. Some of the products sold on the Website may show non-uniform characteristics where these arise from the type of material from which they are made; in that case they form part of the individual appearance of the product and do not constitute a defect.

Specific note on batteries. Discharging and keeping a battery below 12.4 volts starts a sulphation process that reduces its performance, and that reduction cannot be attributed to a manufacturing defect. For that reason, batteries that have been kept discharged, or that reach our premises below 12 volts, will not be accepted under the guarantee. This indication concerns the use and upkeep of the product and does not affect the rights conferred on the consumer by law in the event of an original lack of conformity.

9. Limitation of liability

Save where the law provides otherwise, telebaterias.com will accept no liability for the following losses, whatever their origin:

• any losses not attributable to a breach on its part;
\\n
• business losses, including loss of profits, revenue, contracts, anticipated savings or data, loss of goodwill or wasted expenditure;
\\n
• any other indirect loss that was not reasonably foreseeable by both parties when the contract was concluded.

telebaterias.com likewise limits its liability in the following cases:

\\n
• telebaterias.com applies every measure to provide a faithful display of the product, but is not liable for minimal differences or inaccuracies arising from screen resolution, the browser used or similar circumstances;
\\n
• telebaterias.com acts with the utmost diligence in handing the product over to the company responsible for transport, but is not liable for loss arising from the malfunctioning of transport, in particular strikes, road closures and, generally, any other circumstances inherent to the sector that result in delays, loss or theft of the product;
\\n
• technical failures which, for fortuitous or other reasons, prevent the normal operation of the service over the Internet, as well as the unavailability of the Website for maintenance or other reasons;
\\n
• telebaterias.com is not liable for the misuse or wear of products used by the User, nor for an incorrect return made by the User, it being the User's responsibility to return the correct product.

In general, telebaterias.com will not be liable for any failure or delay in performing the obligations it has assumed where that is due to events outside its reasonable control, that is, to force majeure, which may include, by way of example:

• strikes, lock-outs or other industrial action;
\\n
• civil unrest, riot, invasion, terrorist threat or attack, war (whether declared or not) or threat or preparations for war;
\\n
• fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster;
\\n
• impossibility of using trains, ships, aircraft, motor transport or other means of transport, whether public or private;
\\n
• impossibility of using public or private telecommunications systems;
\\n
• acts, decrees, legislation, regulations or restrictions of any government or public authority.
\\n

Obligations will be suspended for as long as the force majeure continues, and telebaterias.com will have an extension of the period for performing them equal to the duration of that event. telebaterias.com will use all reasonable means to find a solution allowing it to perform its obligations despite the force majeure.

10. Written communications and notices

By using this Website, the User accepts that most communications with telebaterias.com will be electronic (email or notices published on the Website).

For contractual purposes, the User consents to the use of this electronic means of communication and acknowledges that every contract, notice, item of information and other communication that telebaterias.com sends electronically meets the legal requirements of being in writing. This condition does not affect the rights conferred on the User by law.

The User may send notices to and communicate with telebaterias.com using the contact details given in these Conditions and the contact channels of the Website. Unless otherwise agreed, telebaterias.com may contact or notify the User at the email address or postal address they have provided.

11. Waiver

No waiver by telebaterias.com of a particular right or remedy, and no failure by telebaterias.com to require strict performance by the User of any of their obligations, will constitute a waiver of other rights or remedies arising from a contract or from these Conditions, nor will it release the User from performing their obligations.

No waiver by telebaterias.com of any of these Conditions or of the rights or remedies arising from a contract will take effect unless it is expressly stated to be a waiver and is communicated to the User in writing.

12. Severability

If any of these Conditions is declared null and void by a final decision of a competent authority, the remaining clauses will remain in force and will not be affected by that declaration.

13. Entire agreement

These Conditions and any document expressly referred to in them constitute the entire agreement between the User and telebaterias.com in relation to the subject matter of the sale, and supersede any other prior arrangement, agreement or promise, whether oral or written, between the same parties.

The User and telebaterias.com acknowledge having agreed to enter into the contract without relying on any statement or promise made by the other party, other than what is expressly set out in these Conditions.

14. Data protection

Personal data provided by the User in the course of a transaction on the Website will be processed in accordance with the data protection section of the Legal Notice and General Conditions of Use. By accessing, browsing or using the Website, the User declares that all the information they provide is truthful.

15. Applicable law and jurisdiction

Access to, browsing of and use of this Website, as well as contracts of purchase concluded through it, are governed by Spanish law, Spain being the country where the seller is established.

That choice does not deprive a User who is a consumer of the protection afforded by the mandatory consumer rules of their country of habitual residence, which continue to apply in every case.

A User who is a consumer may bring proceedings in the courts of their own domicile and may only be sued in those courts.

16. Complaints

The User may submit complaints, claims or any other comment using the contact details given in clause 1 (General information).

In the event of a consumer dispute, the User may turn to an alternative dispute resolution (ADR) body approved in their country of residence. For cross-border purchases within the European Union, the European Consumer Centres Network provides free assistance in disputes with traders established in another Member State; the contact details of each national centre are available on the European Commission website.

The European online dispute resolution platform (ODR platform) ceased to operate on 20 July 2025 and is therefore no longer available as a complaints channel.
